A sublease agreement is a legal contract in which an existing tenant rents out their leased property to another person (subtenant). It lists the address, sublease term, rent and payments, security deposit, responsibilities under the original lease, and any required landlord consent.

Sublease Agreement Overview

There are a few instances where a current renter might want to sub-lease their rental for a short period of time, including an extended vacation or need to relocate temporarily for work or personal matters. Having someone stay for a short period might be okay, but letting them become a long-term guest could violate the terms of the lease.

The terms of the sub-lease should be clear on the following:

  • The sublessee (temporary renter) is taking over the use of the space based on the sublease terms
  • The original rental agreement between the sublessor (original tenant) and landlord stays in place
  • The sublessor is taking on the role of landlord for the sublessee
  • The sublessor remains responsible for all rent payments and repairs
  • Landlord permission for the sub-lease agreement

Key Elements of a Sublet Agreement

A sublease agreement usually has these key elements:

  • Parties involved: List all party contact info and details for the sublessee, renter and landlord
  • Lease location: The address and clear details of the property being subleased
  • Payment details: The monthly rent amount, due dates, and how payments will be handled
  • Insurance requirements: Does the sublessee need a separate renter’s insurance agreement, or will the renter keep theirs active?
  • Security deposit: List the conditions of the original and additional deposits
  • Utilities: Who is responsible for utilities like electricity, water or trash, and how will payments be handled during the rental agreement?
  • Termination conditions: The circumstances under which the sublease can be terminated, including eviction terms and notices
  • Applicable laws: Which court of law will rule on the agreement, and where will any arguments be resolved?
  • Pet clause (if any): Are pets allowed under the original lease, and how does that apply to the sublease?
  • Signatures: Signing locks in the contract, so be sure all parties complete it

Sublet vs. Sublease: Does It Matter?

The short answer is no. Often, these words are used to mean the same thing. Here's the main difference. With a sublease, responsibility is passed on to the new renter (sublessee). That means the sublessee has to deal with payments and any issues from then on. In a sublet setup, the original tenant finds someone to rent from them directly but stays fully liable to the landlord. So any problems would still be their problem to fix in the end.

    This Sublease Agreement ("Agreement") is made and entered into on  (the “Effective Date”) by and between the Sublessee,  legal name ("Sublessee") and the Sublessor, legal name  ("Sublessor") (collectively, the “Parties”).


    1. Premises

    The Sublessor hereby subleases to the Sublessee the following property (the “Premises”) located at:

    2. Original Lease Terms

    • This sublease is subject to the terms and conditions of the original lease agreement between the Sublessor and the landlord or property owner dated .

    • Sublessee agrees to comply with all provisions of the original lease, including but not limited to restrictions on pets, smoking, occupancy, and maintenance.


    3. Sublease Term

    The sublease shall begin on  and terminate on , unless terminated earlier as provided herein. This sublease is month-to-month and renews automatically unless terminated in writing by either party with  days' notice.


    4. Rent and Payment Terms

    Sublessee agrees to pay rent to the Sublessor as follows:

    7. Amendments to Agreement

    This Agreement may not be modified, altered, or changed in any respect except through a written agreement signed by both Parties. No oral agreements shall be valid. Any request to modify the terms must be submitted in writing and approved by both Parties.


    8. Termination

    This Agreement may be terminated before its expiration:

    • By mutual written agreement of both Parties.
    • By either party for cause, including but not limited to violation of lease terms, with days’ written notice.
    • Without cause, with at least  days’ written notice (if permitted under original lease).

    Upon termination, the Sublessee agrees to vacate the premises and return all keys, access devices, and remove all personal belongings.


    9. Default and Remedies

    A breach of this Agreement includes but is not limited to non-payment of rent, unauthorized occupants or pets, property damage or illegal activities, violation of original lease terms.


    In the event of breach, the non-breaching party may terminate the agreement with written notice, seek damages for financial losses, initiate legal action or eviction if applicable, retain all or part of the security deposit


    10. Dispute Resolution

    In the event of any dispute arising out of or relating to this Agreement, the Parties agree to attempt resolution through informal negotiation. If unsuccessful, disputes shall be resolved through:

    The prevailing party in any dispute shall be entitled to reasonable attorney’s fees and court costs.


    11. Entire Agreement

    This document constitutes the entire agreement between the Parties and supersedes all prior oral or written discussions. No other representations or warranties exist outside this Agreement unless expressly incorporated herein.
